Sale and Purchase
We will sell and you will purchase products subject to our terms and conditions of business set out below. The contract in respect of the products supplied to you by us comes into existence when your order has been accepted by us in accordance with these terms and conditions and payment received. For the avoidance of doubt, receipt of an order via our site does not constitute acceptance of an order.
Price
All prices quoted are in pounds sterling. All prices are inclusive of delivery to any one mainland U.K. address and packaging, unless otherwise stated.
Prices are correct at the time of order, and relate to Internet purchases only. All orders for products are subject to availability and we reserve the right to refuse to supply an individual or other organisation.
Every effort has been made to provide accurate representations of the goods through images and descriptions. There may however be small variations in colour and design when items are viewed online compared to the physical goods. By using this site you are deemed to have accepted this. Please ask if you require further help with the colours represented.
Payment
Payment must be made in pounds sterling only by major credit or debit cards as listed on the site. We also accept UK bank cheques, and UK postal orders for payment. Do not email your card details. No responsibility can be taken for security if you provide your details in this way. Card fraud is illegal and will always lead to prosecution.
Passing of Property
The title of the goods passes to the customer after full payment has been made by the customer, received by us, and the goods delivered.
Our Contract (Order)
The information we seek from you when placing an order is for billing and delivery purposes or for contacting you if we have a query. When placing an order to purchase goods from The Rockshop, you will be sent an email confirming receipt of the order and the order details. A contract between you and The Rockshop will only take place once the order has been accepted, processed and items despatched.
Passing of Risk
The risk in the products will pass to the customer on delivery. The risk in this context is taken to mean any damage or cost arising as a result of the purchased product(s) to either the purchaser, the purchaser’s property or to any other third party property.
Delivery
Any date or time period for delivery will be considered as indicative only and does not form any part of a guarantee. We cannot be held responsible for losses or inconveniences caused as a result of delays in deliveries by us or our suppliers, unless due to our negligence. All products are sent by courier of our choice. All deliveries must be signed for upon receipt unless instructions are given by the customer to the contrary at the time of purchase. We reserve the right to deliver only to the address of the person who is the holder of the credit or debit card used to purchase the products.
If instructions are given to leave goods without a signature then delivery is deemed to have taken place at the point the instructions are carried out by our couriers.
Our courier’s records of any delivery, whether signed for or not, are considered definitive. On delivery of the goods the purchaser of the goods becomes responsible for any losses or damages arising as a result of their use, unless due to our negligence.
Returns, Refunds and Exchanges
Your Order is made especially for you. We cannot accept returns or give refunds if we have manufactured to your specification. In the event that we agree to any goods being returned, the goods will be assessed at our premises and only then will any decision be made regarding the goods and any potential refund. We do not give refunds on items returned after 7 days, or damaged goods not notified to us within 7 days from receipt. Returns should be well packed and labelled clearly. You will receive a full refund of the purchase price. Faulty or damaged products must be returned before the refund can be issued. Please ensure you enclose a note with your name, address and your order ID (found on the order sheet).
It is your responsibility to obtain proof of postage, as should a returned parcel become damaged or lost we do not compensate. You will be responsible for the cost of returning cancelled or unwanted goods. Proof of postage is recommended in the event of loss or damage as we do not compensate for parcels lost in transit.
In cases where the rejection or cancellation date is due to a defect or discrepancy in the order, you will not be responsible for the return delivery charge. When the return arrives back at our shop it will be assessed, and should it be concluded that the products are faulty or that there was a discrepancy in the order, the return delivery charge will be credited back to you on proof of postage receipt and to a maximum of £20.
Right to Cancel
You cannot cancel the order once it is manufactured. If it becomes necessary to cancel, this is acceptable at any time up to the point when your order is manufactured. Your order may be manufactured at any time between the order placement date and the delivery date.
Customs
Goods ordered from The Rockshop for delivery outside the UK may be subject to import duties and taxes, these will be levied once the parcel reaches its destination country. Any charges for customs must be paid by you, we have no control over these and do not know what they may be as customs policies vary from country to country. Contact your local customs officer for full details and regulations.
